License Agreement for FreezeFramesFinder

Version: October 2026

This is a convenience translation of the German "Lizenzvereinbarung für FreezeFramesFinder". In the event of any discrepancy, the German version shall prevail.

Licensor: Thomas Kipp Alcantara, St.-Lucia-Straße 9, 51491 Overath, Germany, support@freezeframesfinder.de, freezeframesfinder.de

§ 1 Scope

(1) This agreement governs the use of the software "FreezeFramesFinder" including its updates (hereinafter the "Software").

(2) The Software is licensed exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. By purchasing, the customer confirms that the Software is acquired for their commercial or independent professional activity.

(3) If the Software is purchased from a reseller acting as the seller, the contract with that reseller governs purchase and payment; the use of the Software is governed by this agreement.

(4) Deviating terms of the customer do not apply, even if they are not expressly rejected.

§ 2 Right of use

(1) Upon full payment, the customer receives a simple (non-exclusive), perpetual right to use the Software in the purchased major version (for example 1.x), including all updates released for it, within the scope of the purchased license:
a) Single seat: one person on up to two computers;
b) Team: up to five people on up to ten computers;
c) Company license: any number of people and computers of the customer at one site (one address).
New major versions (for example 2.0) are not included; the licensor may offer them as a discounted upgrade.

(2) Without a license, the Software may be tested free of charge with full functionality for 14 days from the first start. After that, without a license, it only shows whether and how many freeze frames a file contains. For free use, the licensor, notwithstanding § 6, is liable only for intent, gross negligence and fraudulent concealment.

(3) License keys may only be used within the scope of the purchased license and may not be passed on to third parties. Keys from the online shop are activated online once per computer; a computer can be released again in the Software or in the shop's customer account in order to transfer the license to another computer.

(4) The customer may make the backup copies necessary for secure use.

(5) The customer may not rent out or lend the Software, nor make it available to third parties for use as a service over networks. Copyright notices and license notices may not be removed or altered.

(6) The customer may only transfer a license to a third party in full, and only if the customer permanently gives up their own use, deletes all of their own copies and the third party accepts this agreement.

(7) Modification, decompilation and reverse engineering of the Software are only permitted to the extent that the law mandatorily allows it (Sections 69d, 69e of the German Copyright Act, UrhG) or § 3 provides for it.

§ 3 Open-source components

(1) The Software contains open-source components of third parties, including Python, Tcl/Tk, NumPy, PyAV, FFmpeg, zlib and tkinterdnd2. These are governed exclusively by their respective license terms; they can be found in the Software under "Help → License Agreement and Licenses". This agreement does not restrict the rights under these licenses.

(2) The included FFmpeg libraries are licensed under the GNU Lesser General Public License, version 2.1 or later. The customer may modify the Software for their own use, replace the FFmpeg libraries with their own modified versions, and examine and reverse engineer the Software for debugging such modifications.

(3) The licensor provides the complete source code of the included FFmpeg libraries, together with build instructions, for download alongside the Software. Upon request to support@freezeframesfinder.de the licensor will send it for at least three years after delivery of the respective version, against reimbursement of no more than the cost of sending it.

§ 4 Description of the service

(1) The Software is a checking aid. It examines video files for repeated frames and gives indications of the probable cause and how to fix it. It may miss individual spots or report them incorrectly, for example in very calm shots, at very low bit rates or with unusual formats. It does not replace a professional visual check before delivery or broadcast.

(2) The instructions for fixing in Premiere Pro and After Effects are recommendations; menu names may differ depending on the program version. Premiere Pro and After Effects are trademarks of Adobe Inc. The Software is not affiliated with Adobe.

(3) The Software works exclusively on the customer's computer. It does not transmit any videos or check results to the licensor or to third parties and does not modify the examined files. Only in order to activate a license key from the online shop and to confirm it occasionally does it send the key, the computer name, an anonymous device identifier and the program version to the shop's payment service provider.

§ 5 Claims for defects

(1) In the event of defects, the licensor shall first provide subsequent performance, at its option by remedying the defect or by delivering a defect-free version. If subsequent performance fails, the customer may withdraw from the contract or reduce the price in accordance with the statutory provisions.

(2) Claims for defects become time-barred twelve months after delivery. This does not apply to claims for damages under § 6 or in cases of fraudulent concealment.

§ 6 Liability

(1) The licensor is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee assumed.

(2) In the case of slight negligence, the licensor is liable only for the breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the customer may regularly rely. Liability is then limited to the typical damage foreseeable at the time the contract was concluded.

(3) Otherwise, liability for slight negligence is excluded. These limitations also apply to the licensor's vicarious agents.

§ 7 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the licensor's registered place of business.

(3) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
